Effective July 2009 through present.

When purchasing custom or pre-made Web and/or Graphic design services from Anne K. Riley, client agrees to the following terms and conditions. These terms and conditions are subject to change at any time and without warning and should be read prior to any purchases.

1. Anne K. Riley reserves the right to refuse a project if the theme/content goes against biblical standards of morality. Anne K. Riley is a Christian designer whose goal in designing is to glorify God.

2. The client is responsible for obtaining the proper licensing for any and all blog software used. Support for any blog software will not be provided to the client by Anne K. Riley. The client is solely responsible for obtaining support from the appropriate software’s vendor.

3. Payments are only accepted via PayPal. Payment will be made prior to the client receiving his unique download links. A down payment is required for all custom projects. This payment will be determined based on the client’s payment option needs. Payment of either half of the full price of the project or one-third of the full price of the project can be arranged depending on what the client needs. Full payment must be made within thirty (30) days of the initial down payment date. If full payment is not received within thirty (30) days of the initial down payment date, the project will be closed. To re-open the project, the client will have to pay the full amount as quoted for the project plus a $30 fee. If the project is never re-opened, no refund will be given. Anne K. Riley reserves the right to include any such designs in her pre-made shop.

4. When a custom design is requested, the client guarantees that he owns or has permission from the rightful owner to use any design element such as photography, text, graphics, trademarks, or any other artwork that is to be included in any design by Anne K. Riley and will protect and defend Anne K. Riley from any claim or suit arising from the use of any design elements. Client will also supply the source of any design element that is to be used and included in any commissioned project so that proper credit will be given. Client assumes responsibility and all risk of liability.

5. When a custom design is requested or pre-made purchased, the client understands and agrees that by purchasing any design or design element created by Anne K. Riley, the client is not purchasing the rights to claim, reuse, resell, or redistribute any design or design elements without prior, written permission from the designer, Anne K. Riley.

6. Pre-made themes and pre-made design elements are sold as is. The only exception is blog titles on pre-made theme headers. The title of the client’s blog will be inserted into the graphic before the theme is sent to the client. Any changes aside from the aforementioned are subject to additional fees.

7. “Unique” licensing will be available for all pre-made themes for a limited time. A “Unique” license ensures that the purchaser of the “Unique” license is the only one who will have a copy of the theme, thus making it unique. Once a “Unique” license has been purchased, the theme is removed from the pre-made shop and made unavailable to all except the purchaser of the “Unique” license. The cost of a “Unique” license will be greater than the cost of a standard pre-made license, but still less than the cost of a custom project. “Unique” licenses do not differ from standard pre-made licenses in any other way. They, like standard pre-made licenses, are sold as is. Any changes aside from the exception in section 6 of these terms and conditions are subject to additional fees.

8. The client is only allowed to use each purchased custom project or pre-made theme on one blog. Use of a theme on more than one blog is not permitted UNLESS the client has moved/relocated his blog or permission to do so has been granted by Anne K. Riley.

9. A credit link to Anne K. Riley’s site is required. Client agrees that the credit link back will remain on the site for the life of any design by Anne K. Riley. Removal of this credit link is in direct violation of these terms and conditions and the client’s agreement with Anne K. Riley. The location of this link will be in the footer of the design and will consist of a text link. (Example of a credit link can be found at the bottom of this page.)

10. The client understands and agrees that Anne K. Riley reserves the right to use and display any purchased custom or pre-made design or design elements as part of a portfolio for the purpose of advertisement.

11. Anne K. Riley will not be responsible for providing any back-up copies of any purchased custom or pre-made designs or design elements. The client is solely responsible for saving and storing back-up files of any previous designs and any designs or design elements purchased from Anne K. Riley.

12. Refunds are not available. Once the client has agreed to the terms and has made a down payment, no refunds can be issued.

13. Anne K. Riley will provide 72 hours of customer service to allow for any minor adjustments and maintenance to any custom project. This 72-hour time period will begin once a design is completed and the client is e-mailed a notification of completion. After the 72-hour period is over, additional customer service can be provided for a fee of $50 per hour.

Please do not commit to a project unless you are 100% certain that it’s something you want and that you are willing to wait depending on the timeline you are given.
